Situations I help with

Illustrative situations, written the way I'd talk them through with you. Names and details are fictional.

Age and English decide the nomination plan

Dilini · Temporary Graduate (485), accountant · Victoria

The situation. Dilini is a 31-year-old accountant on a 485 in Melbourne. She asked me which state to chase. I looked at two things first: her age and her English.

How I'd approach it

What I check first. Those two decide how many points she can still add. At 31 her age scores 30 federally and 270 in Victoria's test. At 33 it falls to 25 federally (minus 5) and 240 in Victoria (minus 30). Her age will not wait for her.

The options. Her English is Proficient: 10 federally and 100 in Victoria. Superior would add 10 and 100. That is the one thing she can still change. So we book the English test before anything else. A 190 nomination adds 5 points.

Age and English. Victoria published its 2026 to 2027 test on 13 October. The registration fee is A$60 and a nomination is A$180 (A$66 and A$198 with GST). Registrations from earlier years must be resubmitted when the program opens.

My caution. I cannot promise an invitation. As at 13 October the program had not opened, and places are limited. The English test was simply the best use of her time.

Illustrative situation. The names and details are fictional.

Eight months left, same university

Rahim · Student (500) · In Australia

The situation. Rahim's course ends in eight months. His university has given him extra time to finish his Bachelor at the same provider. He is not sure whether he has to leave Australia to apply again.

How I'd approach it

What I check first. Needing up to 12 more months with the same provider is one of the few cases where a current student can still lodge in Australia. So I check his exact dates, his provider and his course level before I say anything.

The options. If the exemption applies, lodge in Australia with the new confirmation of enrolment or the provider's extension letter. If a leave of absence pushes him past 12 months, the answer changes.

Age and English. Rahim is 24. When he turns 25 he moves into the 30-point age band on the federal test. His Proficient English scores 10 federally and 100 in Victoria. None of this affects the visa today. It shapes what he does after graduating.

My caution. Dates decide this. One extra month on the wrong side of the line changes the whole plan. I would rather check twice than guess.

Illustrative situation. The names and details are fictional.

Twenty-two months on a 482, close to 45

Diego · Skills in Demand (482) · In Australia

The situation. Diego is 43 and has worked full-time on a 482 for 22 months. His employer wants to keep him. He wants permanent residence before his age becomes a problem.

How I'd approach it

What I check first. The Temporary Residence Transition stream needs two years full-time on the 482. Since 1 July 2026 the salary floor is A$79,423 and the visa charge is A$6,140. I check his dates and his pay.

The options. Lodge as soon as he qualifies, and check early whether anything else, such as a skills assessment, applies to him. Priority sectors and onshore applicants have been processed first since 19 September 2026.

Age and English. At 43 his federal age score is 15, but this stream is not points-tested, so it does not count against him. The 45-year line is close, so I plan the lodgement around his birthday.

My caution. Two years full-time means two years full-time. A long unpaid gap can change the answer. I check his payslips first.

Meet Omar

I became a migration agent because I've lived the uncertainty my clients feel — a new country, new rules, and a decision that affects your whole family.

After 10 years helping people navigate Australian visas, I still start every case the same way: understand the person first, then the paperwork.

Questions people ask

What changed for students on 2 October 2026?

Most temporary visa holders, including 485, 482, visitor and working holiday visa holders, can no longer apply for a Student visa from inside Australia. Most current students also apply from outside Australia now, unless an exemption applies — for example moving up to a higher-level course, or finishing within 12 months.

Why are there two fees on every page?

Our fee pays for our work. The government charge goes to Home Affairs (or the assessing authority) and is set by law. We always show them separately, with the date we last checked them.

Do I get the government fee back if a visa is refused?

Generally no. Refunds are only available in limited situations, which is one reason getting it right first time matters.

How does booking work?

Start with a free 15-minute phone call. If you need full advice, book a A$110 consultation — the fee comes off any package you choose. Packages are paid in stages, only after you sign a written service agreement.

How do I know an agent is registered?

Search their MARN on the OMARA register at mara.gov.au. Omar Nafiz's MARN is 2318164.
